But there\u2019s an issue that all email marketers must contend with and that\u2019s falling into the dreaded black hole that is the spam folder.<\/span><\/p>\n

Return Path\u2019s 2017 Deliverability Benchmark Report discovered that 20 percent of all commercial emails wind up as spam.<\/span><\/p>\n

The CAN-SPAM Act<\/strong><\/h2>\n

First, let me briefly touch on the CAN-SPAM Act.<\/p>\n

This is a law that was enacted back in 2003 and sets national standards on commercial email.<\/p>\n

If you\u2019re unfamiliar with it, I recommend taking a look at the CAN-SPAM Act compliance guide from the FTC.<\/p>\n

This highlights the main requirements and outlines non-compliance issues that can get you into trouble. It\u2019s fairly short but will quickly get up to speed.<\/p>\n

Some areas it touches on include not using deceptive email subject lines, including a physical mailing address, telling recipients how to opt-out, and honoring opt-out requests.<\/p>\n

Considering the fact that violations can carry penalties of up to $41,484, you\u2019ll want to be knowledgeable about the ins and outs of the CAN-SPAM Act.<\/p>\n

Besides the ugly potential penalties, failing to comply with these requirements could get your emails sent to spam.<\/p>\n

So this is definitely something to be aware of, especially if you\u2019re new to email marketing.<\/p>\n

Now let\u2019s get down to the nitty-gritty.<\/p>\n

1. You Weren\u2019t Given Permission\u00a0<\/strong><\/h2>\n

The first rule of email marketing is to always have permission<\/em> before sending an email.<\/p>\n

It should go without saying, but you should never buy a list of emails or obtain them through any other unscrupulous means.<\/p>\n

Not only is it unethical, but it\u2019s also ineffective and can potentially land you in some hot legal water.<\/p>\n

So email addresses should only be added when someone willingly opts-in. It\u2019s really that simple.<\/p>\n

Otherwise, there\u2019s a good chance that it will end up as spam.<\/p>\n

Or in a worst-case scenario, you could be subject to a fine.<\/p>\n

2. The Sender Information is Inaccurate<\/strong><\/h2>\n

Here\u2019s what the FTC has to say about the sender information.<\/p>\n

\u201cYou’re \u2018From,\u2019 \u2018To,\u2019 \u2018Reply-To,\u2019 and routing information\u2014including the originating domain name and email address\u2014must be accurate and identify the person or business who initiated the message.\u201d<\/p>\n

In other words, you must clearly state who you are (or who your company is) and not include any inaccurate information that could mislead someone.<\/p>\n

For example, the sender information on my email might say \u201cEmil from Sleeknote.\u201d<\/p>\n

3. There\u2019s No Physical Address<\/strong><\/h2>\n

This may be surprising to some email marketers.<\/p>\n

But the FTC also states, \u201cYour message must include your valid physical postal address.
